1. Who can enter: Open only to Third or Fourth Grade elementary school classrooms in the 50 United States and the District of Columbia. Entry must be submitted by class teacher (or teacher-appointed parent) aged 18 year or older. Void where prohibited or restricted by law or regulation. Not eligible are employees and their immediate families including household members of Foster & Smith, Inc. (Sponsor), or its agents, subsidiaries, divisions, and advertising and promotion agencies.

2. How to enter: To enter, write an essay telling us why in 400 words or less your classroom would benefit from a fish aquarium. Entry must be submitted by class teacher or appointed parent. Enter online by completing the online submission form at www.drsfostersmith.com/contest. The contest consists of one competition which begins at 12:00:01 a.m. CST on January 21, 2009 and ends February 28, 2010 11:59:59 CST. One (1) entry per classroom. Ineligible, illegible or incomplete submissions are void and will not be considered. Submitted essays will not be returned and all submissions become the property of Sponsor. Sponsor is not responsible for lost or damaged submissions or delays in delivery. You may only submit original essays of which you are the sole owner of any copyright or other property or privacy rights. The essay should not include the full name or other personally identifiable information of children.

3. Judging Criteria and Selection of Winners: Submissions will be judged on the basis of originality and creativity; effectiveness in demonstrating how the class would use and benefit from an aquarium; and style, grammar, spelling, punctuation and composition. Judging will be conducted by a panel of aquarium and aquatic pet professionals selected by Sponsor in Sponsor's sole discretion. All decisions by the judges will be final. Twenty-five (25) Contest Winners will be selected by the judges from all eligible entries. Selections will be made by March 15, 2010. Contest winners will be notified by electronic mail and/or telephone using the information provided with the entry. Notification will be attempted a minimum of five (5) times. If any contest winner does not respond to the final notification within three (3) days of its transmission, or if a telephone number is non-operative or email address not operational, the prize may be forfeited.

4. Prizes: Each Winner will be awarded: (a) One (1) 16-gallon Tetra Water Wonders Aquarium including internal filter with media, submersible heater, fluorescent lighting, and set-up guide; (b) 20 lbs of substrate, artificial plant variety pack, one-year supply of whisper bio bags, siphon-kleen, safe start, Tetra Aquasafe, complete water test kit, and fish net ; (c) One (1) collection of fish to be selected by Winner from three options; (d) a one-year supply of fish food, including TetraMin Staple Flakes, TetraVeggie Flakes, and Bloodworms; (e) Complimentary tickets for each child in the class (up to 60) and up to 10 complimentary adult tickets to a national aquarium of our choice. ARV of each prize: $325.00. ARV all prizes: $8,125.00. Costs of travel are not included in the prize. All prizes are non-transferable and not redeemable for cash. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion if the designated prize is unavailable or inappropriate for any reason. All prizes will be shipped directly to winning classroom school.

5. Terms: By entering the contest, entrants: (i) acknowledge compliance with these Official Rules, including all eligibility requirements and copyright ownership of submitted photographs; (ii) agree to be bound by the decisions of the judges, which are final and binding in all respects; and (iii) agree that neither you nor your agents, heirs, successors or assigns will assert any claim relating to damages, losses or injuries against Sponsor, or its agents, affiliates, subsidiaries, divisions, attorneys, printers and advertising and promotion agencies. All entry information becomes the property of Sponsor. Entrants retain the copyright to their essays; however, by entering the contest, entrants grant Sponsor a perpetual, irrevocable, royalty-free, worldwide license to use and display any submitted materials, entrant name and school name on Sponsor website, in Sponsor product catalogs, and within Sponsor advertising and promotions without any fee or other form of compensation. Sponsor may make and retain copies of any submitted essay for contest and archival purposes. This contest is subject to U.S. federal, state and local laws and regulations. Sponsor, or its agents, affiliates, subsidiaries, divisions, attorneys and advertising and promotion agencies (i) makes no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaims any implied warranty; and (iii) is not in any way responsible or liable for damage, loss or injury resulting from altered, late, lost, damaged, misdirected, mutilated, illegible or incomplete entries, or human, telephone, computer, online, or technical malfunctions, failures or difficulties (including busy lines and disconnections) of any kind, or acceptance and use of a prize or travel in connection with such prize. Winners assume liability for injuries caused or claimed to be caused by participating in the contest, or by the acceptance, possession or use of any prize.

6. Conditions: No correspondence will be entered into by Sponsor. Any tax due on the prize is the sole responsibility of the Winner. Sponsor reserves the right to verify eligibility qualifications of all Winners. To be confirmed as a Winner, each selected winner must first complete and return within ten (10) days of receipt from Sponsor (i) an Affidavit of Eligibility and Publicity/Liability Release ("Affidavit") and return them, notarized, and (ii) all taxation forms required by Sponsor. Failure to return all fully completed Affidavits and tax forms within ten (10) business days will result in forfeiture of eligibility to be awarded a prize, and Sponsor will select an alternative prize winner. No substitution or transfer of any prize is permitted. All Winners hereby consent to the use of their name, school name, and submitted essay for promotional purposes without additional compensation, unless prohibited by law. Persons found tampering with or abusing any aspect of this contest as solely determined by the Sponsor will be disqualified from winning any prize. In the event the contest is compromised by a virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor which corrupts or impairs the administration, security, fairness or proper play of the contest, Sponsor reserves the right in its sole discretion to suspend or terminate the contest and award prizes in a later contest. Should the contest be terminated prior to the stated expiration date, notice will be posted at www.drsfostersmith.com/contest. No more than the stated number of prizes will be awarded. Once submitted, entries cannot be changed or withdrawn from the contest.
